The England and Wales Cricket Board (ECB) has appointed Richard Whittam KC as the chair of the newly formed Cricket Discipline Panel (CDP). This independent tribunal is set to replace the existing Cricket Discipline Commission (CDC) and will oversee the enforcement of cricket’s rules and regulations, addressing regulatory breaches in the sport.
Transition from the Cricket Discipline Commission (CDC) to CDP
The Cricket Discipline Commission (CDC), chaired by Tim O’Gorman, previously handled disciplinary cases in cricket. However, the ECB decided to replace the CDC with the new CDP. This change reflects the ECB’s commitment to refining disciplinary processes, adding greater transparency, and ensuring a fair approach to maintaining cricket’s standards.
Richard Whittam KC’s Background and Qualifications
Richard Whittam KC is a distinguished figure in regulatory and criminal law, with a specialty in sports discipline. His legal expertise includes years as a barrister and experience as a deputy high court judge from 2016 to 2022. In 2022, Whittam was appointed Head of Independent Judiciary for the Rugby Football Union, where he chaired panels on discipline and safeguarding. His qualifications make him ideally suited to lead the CDP.
As chair of the CDP, Richard Whittam KC will preside over disciplinary cases in English cricket and appoint members to the panel. Whittam’s leadership will be crucial in establishing a panel with diverse skills to handle a wide range of cases fairly and effectively.
Insights into the Independent Commission for Equity in Cricket (ICEC) Report
In June 2023, the Independent Commission for Equity in Cricket (ICEC) published a report highlighting structural inequalities across race, gender, and class in cricket in England and Wales. This report underscored the need for a revised disciplinary body to handle cases with a fair and transparent approach. The formation of the CDP aligns with the report’s recommendations, supporting equity in the sport.
Responsibilities of the Cricket Regulator
The Cricket Regulator, established in 2023, is responsible for monitoring and ensuring adherence to cricket regulations. This body will bring cases of regulatory breaches to the CDP, allowing the panel to investigate and take appropriate actions. Together, the CDP and Cricket Regulator form a comprehensive system for enforcing standards in English cricket.
Richard Whittam KC has expressed a strong commitment to ensuring fairness in the CDP’s operations. His experience in judiciary roles will support transparent decision-making processes, allowing the public to trust that discipline is being enforced consistently and fairly in English cricket.
Speaking on his appointment, Whittam said: “I am delighted to be appointed to this important role. It is vital to the integrity of cricket that the sport’s rules and regulations are upheld. As the first Chair of the CDP I look forward to getting the Panel up and running and ensuring that cases are dealt with promptly, in a fair, thorough and transparent manner.”
ECB Chair Richard Thompson praised Whittam’s qualifications, stating that his background in law and sports discipline would be invaluable in the role.
ECB chair Richard Thompson said: “The independent Cricket Discipline Panel will play an important role in enforcing cricket’s regulations and dealing with any misconduct and regulatory breaches. Richard Whittam KC has an impressive background in law and sports discipline which makes him the ideal person to chair the Panel.
“I’d like to pass on my sincere thanks to Tim O’Gorman and all the panel members from the Cricket Discipline Commission for the service they have given the game over many years. They have performed an important duty in enforcing cricket’s regulations, and I’m grateful for their continued service while the new Cricket Discipline Panel members are recruited.”
The establishment of the CDP is expected to enhance professionalism in cricket by addressing breaches with transparency. It also reflects the ECB’s dedication to equity, aiming to eliminate biases in discipline and foster a more inclusive environment within the sport.
